It is likely that employers will complete the EA process every three or four years. Organizations need to ensure that they have the best negotiators, as even incremental concessions add up significantly over the duration of an agreement. In addition, it is very difficult to conclude a new provision agreed in an EA and integrated into an EA. There are three types of enterprise agreements: individual companies, multi-company agreements and Green Fields (which may be an individual agreement or agreement with several companies), each of which is discussed below. Once negotiations on the enterprise agreement between the representative parties have been concluded, the agreement will have to be voted on. All workers covered by the outstanding agreement are entitled to vote on the agreement. If the majority of staff who voted valid approve the agreement, the Enterprise Agreement will be submitted to the FWC for approval. Enterprise bargaining sets parameters for labour costs, flexibility in management and decision-making – areas crucial to the efficient functioning of organizations. If SASs are correct, not only will costly errors be avoided, but positive results will also be achieved for employers and workers for the duration of the agreement. Business agreements can be tailored to the needs of some companies. An agreement should be overall better for an employee when compared to the corresponding bonuses or rewards.

The Victorian Chamber has identified 14 different steps in the business negotiation process, beginning with the definition of the organization`s objectives. Under Australia`s labour law, the 2005-2006 industrial reform, known as “WorkChoices”[3] (with the corresponding amendments to the Workplace Relations Act (1996), changed the name of these contractual documents to a “collective agreement.” State industrial legislation may also impose collective agreements, but the adoption of the WorkChoices reform will reduce the likelihood of such agreements occurring.
